FEES & COSTS
An attorney's fee is payment for the services and expertise of your attorney and his or her employees.
A clear understanding of the financial arrangement between an attorney and client is very important. Our firm provides each client with a specific fee agreement detailing fees and costs and sends them regular monthly invoices.
Fees are charged by our law firm in one of three ways:
- Hourly fees are based on the length of time spent on your case or matter. Abraham Lincoln once
said "A lawyer's time is his stock in trade." What he meant is that like a contractor selling houses,
an automobile dealer selling cars, or a farmer selling produce; a lawyer sells his commodity: time.
The time that is spent on your case is billed to you and represents your charges.
Unlike many firms our attorney and paralegal hourly rates include:
- Computer and machine time
- Systems use
- Electronic research
- Travel mileage
- Xerox copies
- Postage
- Long-distance telephone
- Fax charges
- The second way fees can be charged are flat fees. This is a set, agreed upon amount for
a specified amount of work, the scope and extent of which is known beforehand. Some matters such as
business formations, wills, trusts, probates, bankruptcies and criminal matters can be charged as a
flat fee.
When one of our attorneys charges a flat fee, it includes:
- All staff and paralegal functions
- Computer and machine time
- Systems use
- Electronic research
- Travel mileage
- Xerox copies
- Postage
- Long-distance telephone
- Fax charges
- The third way fees can be charged are contingent fees. This is an arrangement between
the attorney and client whereby the attorney agrees to represent the client with the compensation to
be a percentage of the amount recovered by judgment or by settlement before or after suit is
commenced. The contingent fee is usually between 25% and 40%.
Regardless of which type of fee structure is agreed upon out of pocket costs or disbursements paid by
our firm on behalf of a client are always reimbursed to us by the client. These costs can be court
filing fees, recorders fees, hearing or trail transcript fees, outside experts and other related costs.
